"Berkeley Castle (historically sometimes spelt Berkley Castle) is a castle in the town of Berkeley, Gloucestershire, UK (grid reference ST685989).

It was constructed from 1154 A.D., on the orders of Henry II, with the aim of defending the Bristol - Gloucester Road, the Severn estuary and the Welsh border. It continues to belong to the Berkeley family, descendants of Robert Fitzharding, who completed the keep around 1189.

King Edward II of England was held in the castle for 5 months from April to September, before being murdered September 21st 1327 there by unknown means, although popular stories of a red hot poker or suffocation persist and the murderers were charged with suffocating the King. The cell where he is
supposed to have been imprisoned and murdered can still be seen, along with the adjacent 28' deep dungeon, which supposedly echoes the events of the murder every year on September 21. The castle has remained within the same family since its construction, with most areas now open to the public, the private apartments occupy about 15% of the building and the rest is managed by the Berkeley Castle Charitable Trust. It is the oldest continuously-occupied castle in England after the royal
fortresses of The Tower of London and Windsor and the oldest to be continuously owned and occupied by the same family.[1]

In the 14th century, the Great Hall was given a new roof and it is here the last Court Jester in England, Dickie Pearce, died after falling from the Minstrel's Gallery. His tomb is in St Mary's churchyard which stands besides the castle. Adjoining the Great Hall is one of two of the original chapels, that includes
painted wooden vaulted ceilings and one of the first examples of a biblical passage (from the Book of Revelation), written in the language of those who read it - Norman French, it is the earliest attempt to translate the Bible into a common language. This room also contains an illustrated vellum book of plainsong that was used in Catholic rites, before the family converted to Protestantism in the 16th
century. In the 20th century, the 8th Earl Randall repaired and remodelled parts of the castle and added a new porch in the same gothic style as the rest of the building. One change included an Art Nouveau take on a Medieval bedroom.

The castle is surrounded by beautiful Elizabethan terraced gardens, including Elizabeth I's bowling green and a pine that is reputed to have been grown from a cutting taken from a tree at the Battle of Culloden in 1746.

During the English Civil War, the castle still held sufficient significance for it to be captured in 1645 by Colonel Thomas Rainsborough, for the Parliamentarian side and after a siege which saw cannon being fired at point blank range from the adjacent church roof of Saint Mary the Virgin, the Royal garrison surrendered. As was usual, the walls were left breached after this siege but the Berkeley family were allowed to retain ownership on condition that they never repaired the damage to the Keep and Outer Bailey, still enforced today by the original Act of Parliament drawn up at the time; according to Pevsner, the breach is partially filled by a subsequent 'modern' rebuild, but this only amounts to a low garden wall, to stop people falling 28' from the Keep Garden, the original Castle's "motte".

Two ships of the Royal Navy have been named Berkeley Castle after the castle, as has a Great Western locomotive.

The Berkeley family divide their time between the Castle and their other home, Spetchley Park, just outside Worcester, which has been in the family's ownership since 1606.

A Restoration Appeal was launched in 2006 to raise £5.5 million needed to renovate and restore the Norman building. The Charitable Trust running the Castle is relatively small.

The castle was used for many scenes for the hit BBC children's television series The Ghost Hunter and the first televised version of The Other Boleyn Girl."

Maurice VII "The Lawyer" de BERKELEY - 3rd Baron
Isabel MEAD
"Though Maurice Berkeley inherited the title of Baron from his elder brother
William, the 2nd Baron, William had given Berkeley Castle to the crown: Henry VII
(and his male heirs). The family did not get the Castle back until after the death
of Edward VI of England in 1553. Some say that William gave the Castle and
most of the rest of the huge Berkeley estate away partly because he disapproved
of his nephew & heir, Maurice's marriage to Isabel Mead, as it was below his
station.

Maurice Berkeley, de jure 3rd Lord (Baron ) Berkeley (after his elder brother
William, the 2nd Lord and 1st and last Marquess Berkeley whose male children
all died without issue); Knight of the Body to Edward IV; married 1465 Isabel
(died after 29 May 1514), daughter of Philip Mead, of Mead's Place, Wraxall,
Somerset, Alderman and thrice Mayor of Bristol, and died Sep 1506. [Burke's

BARONY of BERKELEY (III) 1492

MAURICE [BERKELEY] de jure [apparently] LORD BERKELEY [1421] brother of
the whole blood and heir, who "may bee called Maurice: the Lawier " inasmuch
as though totally disinherited by his brother, and though 56 years of age at his
brother's death, he recovered, within 7 years, upwards of 50 manors and other
lands, the alienation of which had been effected illegally. He had been Knight of
the body to Edward IV.

He married, in his 30th year (1465), Isabel (at that time a widow with 3 children
who all died young), only daughter of Philip MEAD, of Mead's Place, in Wraxall,
Somerset, Alderman, and three times (1458-59, 1461-62, 1468-69) Mayor of
Bristol, by Isabel, his wife. She became heir to her brother Thomas Mead,
inheriting lands at Thornbury, co. Gloucester, and at Wraxall, Ashton,
Bedminster, and Tickeiiham, Somerset. He died September 1506, aged 70, and
was buried at Austin Friars, London. His widow died after 29 May 1514, at the
same age of 70, at Coventry, and was buried with him. [Complete Peerage II:135"

BARONY of BERKELEY (I) 1421

JAMES (DE BERKELEY), LORD BERKELEY, nephew and heir male, being son
and heir of Sir James de Berkeley, by Elizabeth, daughter and heir of Sir John
BLUET, of Raglan, co. Monmouth, which Sir James, being next brother to
Thomas, the last Lord Berkeley, died v.f., 13 June 1405. He was born about
1394, at Raglan, and "may bee called James the Just." He succeeded to the
Castle of Berkeley (to which the Barony of Berkeley was then very generally
considered as appendant) and other estates under an entail of his
great-grandfather, but was much hindered in getting possession thereof by the
Countess of Warwick (daughter and heir of the last Lord), the heir general. By
writ directed Jacobo de Berkeley, he was summoned to Parliament 20 Oct ober
1421 to 23 May 1461, and was knighted by Henry VI, in May 1426.

In April 1410, being then aged 16, he m., 1stly, or perhaps was only contracted
to, a daughter of Sir John ST. JOHN (contract dated 19 April 1410. He married,
2ndly, 1415), a daughter, of Sir Humphrey STAFFORD, of Hook, Dorset, but she
died very young and s.p. He married, 3rdly, 1423-24, Isabel, widow of Henry

arrested by order of Margaret, Countess of Shrewsbury (granddaughter and
coheir of the last Lord Berkeley), and imprisoned at Gloucester, where she died
27 September 1452, and was buried in the church of the Greyfriars there. He
married, 4thly, (Settlment 25 July 1457) Joan, daughter of John (TALBOT), 1st
EARL OF SHREWSBURY, by his 1st wife, Maud, elder daughter and heir of
Thomas (NEVILL), LORD FURNIVAL, which Joan was consequently
stepdaughter of Margaret, Countess of Shrewsbury abovenamed. He died at
Berkeley Castle, Nov 1463, within 36 days of having (22 Oct.) executed a deed of
reconciliation with the said Countess and was buried at Berkeley. His widow
married, before 26 May 1474, Edmund Hungerford. [Complete Peerage II:132-3,

James Lord Berkeley (1394-1463)

James Lord Berkeley, was married to Isabel Mowbray (see The Mowbray family).
James was in dispute with his uncle's heirs for most of his life. His uncle,
Thomas the Magnificent, 10th Lord Berkeley (there is a fabulous brass of him
and his wife at Wooton-under-edge in Gloucestershire), left a solitary daughter,
Elizabeth, who married the powerful Richard Beauchamp (1382-1439), Earl of
Warwick, and guardian of Henry VI. They had three daughters. The eldest,
Margaret, married the feared John Talbot (1388-1453), Earl of Shrewsbury, the
youngest married Richard Neville, later Earl of Warwick (1428-1471).

During the long dispute over ownership of the Berkeley estate, Isabel was
captured by the Countess of Shrewsbury and died in 1452 in prison in
Gloucester. James promptly remarried the daughter of the Earl of Shrewsbury.

The family dispute is claimed to be the longest dispute in English legal history.
During this period the village of Berkeley was burned down twice - once by each
side - for 'supporting the enemy', i.e. paying them rent. The life of ordinary people
during this time must have been hard indeed. The dispute was eventually
resolved by open battle (see Battle of Nibley Green).

James and Isabel's third son James was killed in battle in France (Castillon
1453) along with John Talbot in the closing battle of the Hundred Years War.
Father and son are buried at St. Mary's Berkeley, and there is a splendid stone
effigy of them both in full armour in a small chapel to the side of the chancel.
Isabel was buried at Greyfriars in Gloucester in 1452. The abbey was destroyed
in the dissolution, and is now partly ruined, where now stands a fine Georgian
building, the County music library, contained within the ribs of the medieval
building."

21 Maurice IV de BERKELEY - The Valiant
Elizabeth le DESPENSER
"He [Maurice de Berkeley] m. in Aug 1338 (when aged about 8) Elizabeth,
daughter of Hugh Despenser, the younger, (Lord le Despenser) by Eleanor, 1st
sister of the whole blood and coheir of Gilbert de Clare, Earl of Gloucester and
Hertford, [daughter of Gilbert de Clare, of same], "but though thus m. at 8, yet had
he no issue by her till about 12 or 13 years after." He d. at Berkeley Castle, "never
thoroughly cured of the wounds hee received at Poytiers", 8 June 1368, aged 37
and upwards, and was buried with his mother at St. Augustine's, Bristol. Inq.p.m.
12 July 1368. His widow d. 13 July 1389, and was buried at St. Botolph's,
London. Complete Peerage II:130, XIV:87

!Elizabeth le Despenser, daughter and coheir [of Alianore de Clare and Sir Hugh
le Despencer], died 13 July 1389, married Aug 1389, Maurice de Berkeley, Lord
Berkeley, son of Thomas, Lord Berkeley, and Margaret, daughter of Roger
Mortimer, Earl of March; aged 8 years at marriage. (she was his age or younger);
died Berkeley Castle, from wounds received earlier at Poitiers, 8 June 1368, age
37. (All their children born some years after marriage.) [Magna Charta Sureties]

Note: The marriage date of Aug 1389 is so obviously wrong that I am not putting
it as an alternative. It is probably the burial date for Elizabeth. As far as
Elizabeth's birth date, it would have to be on or before 1327, since her father died
in 1326. Maurice's death date of 8 June 1368 does not agree with any of the
other sources, which state 3 June 1368. The death by wounds received at battle
of Poitiers agrees with Burke's Peerage, even though the battle took place in
1356 (12 years earlier)."

(b) It has hitherto been stated that he was knighted in Scotland in 1337, when
aged 7!, and was fighting abroad some years later, but J. H. Round points out
that a footnote in Wrottesley's "Crecy and Calais", p. 196, explains that he has
been confused with his father's younger brother, Maurice, who fought at Crecy,
was at the siege of Calais, and d. 12 Feb 1346/7."

!Thomas de Berkeley, Lord Berkeley, son and heir by 1st wife, who "may bee

his father's death. He fought at Boroughbridge, 16 Mar 1321/2, and was taken
prisoner. He was released from imprisonment in Pevensey Castle on 16 Oct
1326, and on 4 Apr 1327, was made Joint Custodian of the deposed King
Edward II, whom he "curteously received" the next day at Berkeley Castle, but
being commanded to deliver over the government thereof to his fellow custodian,
departed therefrom to Bradley, "with heavy cheere perceiving what violence was
intended." He was tried by a jury of 12 Knights (without protest) in 1330-1 as an
accessory to the murder (g) of the deposed King, but was acquitted. In 1328 he
was in the expedition against Scotland. From 14 June 1329 to 20 Nov 1360, he
was summoned to Parliament, the last two writs have the addition of "Senior"
thereto. In 1336 he was Chief Warden of cos. Gloucester, Worcester, and
Hereford; in 1340, Marshal of the English army in France; in 1342, Capt. of the
Scottish Marches; Warden and Chief Justice in Eyre south of Trent 1345-48; he
is stated (apparently in error) to have been, in 1346, Commander of the English
forces at the battle of Crecy, and in 1361, was on an Embassy to Pope Innocent
VI. He m. 1stly, in or shortly bef. 25 July 1320 (Papal disp. to remain married with

buried in Berkeley Church. M.I. His widow d. 13 Mar 1385, and is also buried
there. [Complete Peerage II:129-30, XIV:87]

(g) This was perpetrated with horrible barbarity by Sir John Mautravers and Sir
Thomas Gurnay, the then custodians of the castle. See a detailed account in
Smyth's "Berkeleys", vol i, p. 291, confirming the allusion in Gray's "Bard" to
...."The shrieks of death thro' Berkeley's roof that ring--
....Shrieks of an agonising King."

This lord having adhered to the interest of the Queen, Mortimer, and Prince
Edward, afterwards the third of that name, furnished "the only precedent," says
Smith, "of a peer being tried by knights, as the peers would have been both
judges and jurors." He first assumed a mitre for his crest. He was summoned to
parliament from 1329 to 1360. He had issue by his 1st wife, besides his heir,
three sons, who d. s. p., and one dau., Joan, wife of Sir Reginald Cobham; by his

date).

Wars 1295-1318; at Siege of Carlaverock July 1300, called to Parliament 1308 in
his father's lifetime by a series of writs worded to him as "Maurice de Berkeley",
which by a later interpretation would have meant that he was made Lord (Baron)
Berkeley in a separate creation to that of his father, but in fact there is no record
of his having taken his seat, Warden Gloucester 1312, Capt Berwick 1315,
Commissioner to Scotland 1316, Chief Justiciar of South Wales 1316,
Seneschal of Aquitaine 1320, joined the Earl of Lancaster's insurrection against
Edward II and his favourites the Despensers 1321 but was captured and
imprisoned in Wallingford Castle. [Burke's Peerage]

!MAURICE (DE BERKELEY), LORD DE BERKELEY, son and heir, who "may bee
called Maurice the Magnanimous," born April 1281 (b). He distinguished himself
in the Scottish wars, 1295-1318, and was at the siege of Carlaverock in July
1300. He was summoned to Parliament v.p., from 16 August 1308 to 15 May
1321 by writs directed Mauricio de Berkeleye, whereby he may be held to have
become LORD BERKELEY, though there is no actual record of his having sat in
Parliament. He held several important posts, v.p., being Warden Of Gloucester,
1312; Capt. of Berwick, 1315; one of the Commissioners to Scotland, 1316;
Chief Justiciar of South Wales 1316, and Seneschal of Aquitaine, 1320. Shortly
afterwards he joined the Earl of Lancaster in the rebellion against Edward II and
the Despenser family, and within 6 months of his father's death was sent
prisoner to Wallingford Castle, 20 Jan 1321/2, where he d. about a year
afterwards. He m. 1stly 1289 (neither party being aged over 8), Eve, sister of
William la Zouche (Lord Zouche of Haryngworth), and daughter of Eon la Zouche,
by Millicent, sister and coheir of George de Cauntelo, Lord of Abergavenny,
daughter of William de Cauntelo, of Calne, co. Wilts and Aston Cantlow, co.
Warwick. She d. 6 Dec 1314, and was buried in Portbury Church, Somerset. He
m. 2ndly, about 1316, Isabel, daughter of Gilbert de Clare, Earl of Gloucester and
Hertford, by his 1st wife Alice, daughter of Hugh XI, called le Brun, Sire de
Lusignan, Count of la Marche and Angouleme (uterine brother of Henry III). He d.
as aforesaid, 31 May 1326 , and was buried at Wallingford, but removed to St.
Augustine's, Bristol (c). Inq.p.m. Feb 1326/7. His widow, who was b. 10 Mar
1262/3, dsp 1333. [Complete Peerage II:128-9, XIV:87]

(b) This makes him a father at the age of 14, for which Smyth quotes the Biblical
precedents of Solomon and Ahaz, each a father at 11 and of King Josiah at 14,
and adds that his own "small reading could parallel more than a dozen other
parents which have been Fathers and Mothers at 14 years". The date of birth
appears to rest on his being found to be 40 years old in 1321 in two inquisitions
on his father's death, "and" says Smyth "he best knew his own age that sett it
down." It is however now recognised that the age of men in middle life being a
matter of little practical importance, is seldom given with any degree of accuracy
in the inquisitions. His birth (as the elder son of his parents) would more
probably be in 1271 than in 1281, ie. after some 4, rather than some 14, years of
their marriage.

(c) From his 2nd son, Maurice, descend the Berkeleys of Stoke Gifford, co.
Gloucester (Lords Botetourt), the Berkeleys of Stratton, Cornwall (Lords Berkeley
of Stratton) and the Berkeleys of Pyll, of which families the last is now (1911)
represented in the male line by Viscount Portman.

BARONY of BERKELEY (I)

THOMAS DE BERKELEY, feudal LORD OF BERKELEY, 2nd, but 1st surviving
son and heir (c), who "may bee called Thomas the Wise." He was born at
Berkeley 1245, was at the battle of Evesham when under age, and was for nearly
every year for the last 50 years of his life "employed either against the Welsh., the
Scots, or the French." He was summoned to attend the King at Shrewsbury 28
June 1283 by writ directed 'Thome de Berkel', which writ was actually treated in
the Mowbray case (1877) as one which created an hereditary Peerage. On 24
June 1295, he was summoned to Parliament by writ directed Thome de
Berkelegh', whereby he may be held to have become LORD BERKELEY. He
continued to be so summoned till 15 May 1321. He was made Vice-Constable of
England in 1297, was at the bloody battle and defeat of the Scots at Falkirk 22
July 1298, the siege of Carlaverock in July 1300, and was taken prisoner at the
battle of Bannockburn, 24 June 1314, paying a large sum for his ransom. He
was likewise on the Commission to examine the claims to the Crown of
Scotland, June 1292; was on an Embassy to France, January 1296, and to Pope
Clement V, in July 1307. He married, in 1267, Joan, da. of William (DE
FERRERS), EARL OF DERBY, by his 2nd wife, Margaret, daughter and coheir of
Roger (DE QUINCI), EARL OF WINCHESTER. She died in March 1309/10, and
was buried at St. Augustine's, Bristol. He died 23 July 1321, at Berkeley, aged
about 76. [Complete Peerage II:127-8, (transcribed by Dave Utzinger)]

(c) Maurice, his elder brother, was killed in a tournament at Kenilworth, vp in
1279.

---------------------------------------------------------

Thomas de Berkeley, b. at Berkeley in 1245, was summoned to parliament by
writ as a baron from 23 June 1295 to 15 May 1321. This nobleman was of great
eminence in the reigns of Edward I and and Edward II, being in the French,
Welsh, and Scottish wars of those periods, particularly at the celebrated siege of
Caerlaverock. He was involved, however, at the close of his life in the treason of
Thomas, Earl of Lancaster. His lordship m. circa 1267 Jane, dau. of William de
Ferrers, Earl of Derby, and dying July 23, 1321 (his wife d. 19 Mar 1309], left
issue,

I. Maurice, 2nd baron

Alice de BERKELEY
"Lord of Berkeley. He is also known as Maurice de Berkeley. He was styled
"Maurice the Make Peace." He received on the same date, 1155, as his father a
confirmation of the grant of Berkeley from Henry II, and again on October 30,
1189, from Queen Eleanor, regent for Richard I. In 1190 he was justice itinerant
in Gloucestershire. He enlarged Berkeley Castle, which thenceforth became the
chief seat of, and gave the name to, the family. His father arranged his marriage
to Alice de Berkeley, after he acquired the lordship of Berkeley. Thereafter
Maurice and his descendants adopted the style of Berkeley.

Maurice de Berkeley strengthened his tenure of Berkeley Castle by marrying, at
the instigation of Henry II, Alice, dau. and heiress of the ousted lord, Roger de
Berkeley, of Dursley. By this lady he had six sons, and was s. by the eldest,
Maurice de Berkeley. [John Burke, History of the Commoners of Great Britain and

Roger III de BERKELEY
Mrs de BERKELEY
"He succeeded his father William after about 1141. He completed the building of
Berkeley Castle. He suffered much in the war between Stephen and Matilda at
the hands of Walter, son of Miles, earl of Hereford. He "under went" says
Dugdale, "a very hard fate, through the perfidiousness and cruelty of Walter,
brother to Milo, earl of Hereford, his seeming friend, and kinsman by
consanguinity, being treacherously seized on, stripped naked, exposed to scorn,
put into fetters, and thrice drawn by a rope about his neck, on a gallows, at his
own castle gates, with threats that if he would not deliver his castle to the earl, he
should suffer a miserable death; and when he was, by the barbarous usage,
almost dead, carried to prison, there to endure further tortures." He was deprived
of the manor of Berkeley about 1152, apparently for refusing to recognize the
authority of either party, although he was soon afterward restored to the honor of
Dursley. Berkeley Castle and the "herness" of Berkeley were granted to Robert
FitzHarding by Henry II.

ROGER DE BERKELEY, son and heir, who completed the building of the Castle
of Berkeley. He suffered much in the wars between Stephen and the Empress
Maud, at the hands of Walter, son of Miles, Earl of Hereford. He was deprived of
the Manor of Berkeley, &c., about 1152, apparently for refusing to recognise the
authorIty of either party, though he was soon afterwards restored to the Honour
Of Dursley (c). He died about 1170, leaving issue. The Castle and "herness" of
Berkeley were granted by the King [to Robert FitzHarding]. [Complete Peerage

issue of his son and heir, Roger de Berkeley, by Helen, 1st daughter of Robert
Fitz Harding, his successor in the lands of Berkeley for eight generations, when
Nicholas Berkeley, the heir male, died s.p. in 1382. By the heir general, Robert
Wykes, it was alienated in 1564. In 1404, by the death of Sir Nicholas Berkeley, of
Coberley, co. Gloucester, the whole of the male issue of Roger, the founder of
this race, became extinct."

Roger I "Senior" de BERKELEY
Rissa
"He is styled "Roger de Berkeley Senior." Between 1068 and 1071, he was made
provost of the manor of Berkeley by earl William FitzOsbern, to whom it had been
granted at the Conquest. The manor, with its appendant district, Berkely
Herness, was an escheat of the Crown after its forfeiture in 1051 by earl Godwin.
Roger took the name of de Berkeley from his residence there. He was confirmed
in his office by the King about 1080. At the time of the Domesday survey in 1086,
Berkeley was farmed by him from the Crown. He was tenant "in capite" of
Dursley, Cubberley, Dodington, and other estates. On January 17, 1091, he
resigned his lands and became a monk of St. Peter's, Gloucester, having
restored to the monks the manor of Shotover, which he had held unjustly.

! Roger, styled "Senior," who, having, between 1068 and 1071, been made
Provost of the manor of Berkeley by Earl William Fitz Osbern (to whom it had
been granted at the Conquest), took the name Of DE BERKELEY from his
residence there, and was confirmed in his office by the King about 1080. At the
time of the Survey 1086, Berkeley was farmed by him from the Crown. He was
tenant in capite of Dursley, Cubberley, Dodington, &c., and (not improbably) was
identical with " Roger," farmer of Barton Regis, Bristol. On 17 January 1091 he
became a Monk of St. Peter's, Gloucester, and died 1093. [Complete Peerage
